EPC Terms and Conditions

By placing an order with PK Mortgages & Properties is a trading name of SKAD Properties & Development Ltd, you are accepting our terms and conditions. Your existing statutory rights are not affected by these conditions. Terms & Conditions updated March 2021.

These Terms and Conditions (‘the Terms’) govern your relationship with PK Mortgages & Properties. Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these terms, please do not place an order online for a service with us.

All orders for services accepted by us will be subject to the following Terms which will form part of and will govern the contract of service. No variation of these Terms will be accepted unless agreed in writing by an authorised person of PK Mortgage & Properties. We will not accept the inclusion of any alternative terms by you that conflict with, alter or add to these terms.

1. Orders

1.1 When you place an order for a service, this will be regarded as an offer by you to purchase the service subject to these terms and we shall not be obliged to accept your offer at our discretion.

1.2 We will send you an Order Acknowledgement on receipt of your order. This is not an order confirmation or order acceptance by us.

1.3 The Order Confirmation will be binding on you unless there is an inadvertent discrepancy between the service that you ordered and those detailed in the order confirmation. You should notify us as soon as you become aware of any such discrepancy.

1.4 You agree to ensure that the information that you supply to us in the order including without limitation details of the property is complete, accurate and up to date. You will notify us immediately when you become aware of any inaccuracy contained within the order.

2. Prices and Payments

2.1 We do not charge VAT on any of our prices, the price advertised is the price paid.

2.2 Services are invoiced at the price prevailing at the time of your order.

2.3 If you make the payment through BACS or Cash then please make sure that payment should be clear 24 hours prior to an appointment and if making cash then prior to the assessment on the arrival of an assessor

2.4 If you pay the Booking fees then remaining cash payment require paying to assessor directly on the day of appointment but prior starting to the assessment and you can also request assessor to give you the invoice (if required).

2.5 EPC Assessment will not be carried if the required payment for the services is not paid prior to the start of assessment.

2.6 We reserve the right to vary our prices from time to time.

3. Appointment Booking & Assessment Duration

3.1 When assessor will make an appointment then can give you confirmed time or 2 hours time slot. We agreed with assessor for time slot because sometime assessor stuck in the traffic jam, some appointment take longer due to property size, vulnerable customer or far distance from one appointment to another. In time slot, our assessor can arrive any time between the start of your slot and the end of your slot.

3.2 Appointment will be re-scheduled due to some exceptional circumstances or factors beyond our control such as assessor fall sick, personal or family circumstances or transport issues etc. If it is necessary to do this, assessor will attempt to contact you to try and re-schedule another appointment as soon as possible at a mutually convenient time. We take it very seriously and carefully checking time to time, assessors are not misusing the exceptional circumstances policy.

3.3 In some cases, if assessor do not attend the booked appointment and even not contact you for any changes due to exceptional circumstances then firstly contact to assessor directly, if assessor do not answer your phone then please contact us ASAP through online contact us method or sending us the text on 07913 225 726. We will try to resolve the issue within 24 hours.

3.4 All our EPC assessment will take 30-60 minutes to complete depend on the size of the property but require an access to the entire property and authorised or any adult must be at home during an assessment. Otherwise, assessment will not be carried out and appointment will be cancelled.

4. Missed Appointments or Appointment changes

4.1 If you want to make any changes with your current appointment date & time but at least 24 hours before your current booking time then please contact to assessor directly to re-book an appointment. If assessor do not answer the phone then please send us text on 07913 225 726 as soon as possible by sending your Name, property Address (House No. & postcode only), current & required appointment date & time. Any appointment changes within 24 hours before the actual appointment time will not cost you if assessor agrees to re-schedule an appointment but if assessor is unable to change the appointment due to short notice and you contact us for appointment changes then administrative charge of £15.00 will be incurred as it will increase our work load.

4.2 If customer missed the appointment without notifying us then customer require to pay the missed appointment charges of £15 as it will cover our admin cost and assessor travelling & missed appointment time cost.

4.3 Pre-arranged appointments with the Domestic Energy Assessor are taken on the understanding that an Adult will be present at the appointment time. If the DEA/GDA is unable to obtain access to the premises within 15 minutes of the appointment time due to unavailability of any adult during assessment then consider as a ‘missed appointment’ and missed appointment charges of £15 is payable for re-booking or cancelling the service. A result of this may also delay in the production time of your order and additional cost will be incurred

5. Termination of Contract

5.1 PK Mortgages & Properties reserves the right to terminate the contract at any time.

5.2 PK Mortgages & Properties will not tolerate aggressive/rude behaviour, racism, nationalism, sexism, homophobia or ageism directed towards any of its assessors, staff or sub-contractors.

6. Your Right to Cancel

6.1 You are entitled to cancel your order free of charge for any reason within 48 hours from the original order placed time but no later than 24hrs before an assessor is due to visit your property (Whichever come first) but if you cancel your order after 48 hours or less than 24 hours before an assessor is due to visit (Whichever come first) then you require paying the cancellation charges of £15. Any missed appointment, appointment changes and appointment cancellation cost will issue you the invoice to pay off within 28 days and if not paid with 28 days then legal action can be taken against you and the legal cost will be applied to you and your information will be passed to credit agencies that may affect your credit rating in future.

7. Errors and Omissions

We make every effort to ensure that our website contents are correct and accurate. In the case of a manifest error or omission, you will be entitled to cancel your order without deduction of any amount paid for our services.

8. Data Protection

8.1 Order form requires you to give us contact information (such as name, Phone number, email, and postal address). This data is securely stored and not pass to any marketing or surveyor agencies.

8.2 We may share your information with selected 3rd parties to let you know about goods or services available for your property that may be of interest to you. Please contact us if you wish to opt-out of receiving such information.

9. Your Obligations

9.1 In case of an Energy Performance Certificate. You agree to present any insulation certificates available at the time of inspection to the assessor. Any instance where the certificates or documentary evidence are not available may result in insulation being recorded as ’not present’ or ‘unknown’.

9.2 You agree that if you note an error within the certificate either with the rating, recommendation or address you will highlight this within 10 Days of instruction of the service. After this date we are unable to make amendments or on discretion of the company.

9.3 During the assessment, assessor will take the notes of present elements available in the property and will lodge the report on the basis of available elements. Any modification or improvements in the property after the assessment for improving the energy rating of the property will not be amended in the original survey but if you require the new EPC report after modifications in the property then require to book the new appointment.

10. Liability

10.1 We cannot accept any liability for any error in an EPC, which is based on any error or inaccuracy in a public register. Nor will we be liable for any information contained within an EPC, which is based on information that we have obtained from a third party (not being information derived from the public register).

10.2 We cannot accept any responsibility for any inaccuracy or error in the EPC that is based on incomplete or inaccurate information supplied by you and due to access restriction.

10.3 Subject to any other provisions in these Conditions, we will not be liable to you for any loss, damages, costs or expenses caused directly or indirectly by a delay in delivery to you.

10.4 We are not liable for any damage & losses in the property during assessment but any damages occurred due to assessor’ mistake then it will be covered by an assessor insurance as all assessors have their own insurance policy that cover them and each property they survey. For more information, you can ask about this directly to the surveyor regarding their insurance if any damage occurs to you property.

Please note that all terms in this contract apply to any third party you instruct to be at a premises on your behalf e.g. estate agent, housing officer or tenant etc that will be giving us an access to the property the same terms apply.

The above terms & conditions are an agreement between PK Mortgages & Properties and customers/clients placing an order.
